Terms of Service

Welcome to Hinglishly AI Captions ("we," "our," or "us"). These Terms of Service ("Terms") govern your download, installation, and use of our mobile application (Hinglishly AI Captions) and any associated services, features, or content provided by us (collectively, the "Service").

By downloading, installing, registering for, or using Hinglishly AI Captions, you agree to be bound by these Terms. If you do not agree to these Terms, please do not install, access, or use the application.

1. Description of Service

Hinglishly AI Captions is a mobile application designed to help content creators generate and edit automated captions for videos. Key capabilities of the Service include:

• Audio Transcription: Extracting audio from your selected video files and transcribing speech into high-quality captions.
• Hinglish Conversion: Utilizing advanced language processing to format, style, and convert speech into readable Roman Hindi (Hinglish) or standard captions.
• Caption Styling & Customization: Providing custom fonts, colors, animations, templates, and positions to style captions on the video canvas.
• Video Exporting: Packaging the styled captions and rendering the final captioned video to your device.

2. Eligibility

You must be at least 13 years of age to download, install, or use Hinglishly AI Captions. If you are under the age of 18 (or the age of legal majority where you live), you may only use our Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. Account and Authentication

• Phone Authentication: To use Hinglishly AI Captions, you must authenticate using a valid phone number via Firebase Phone Authentication.
• Account Responsibility: You are solely responsible for maintaining the confidentiality and security of your account and credentials. You agree to notify us immediately of any unauthorized use or security breach of your account.
• Account Suspension/Termination: We reserve the right, in our sole discretion, to suspend or terminate your account and restrict your access to the Service for any violation of these Terms or for behavior that is harmful to other users or our business interests.

4. Subscriptions and Payments

Hinglishly AI Captions offers both free and premium features.

A. Free Tier & Quotas

Upon sign-up, you receive access to a free tier with a limited quota of video exports. Export quotas are tracked in our database per account. We reserve the right to modify the free tier limits and features at any time.

B. Paid Subscriptions (Creator Monthly)

You may purchase a recurring monthly subscription (e.g., Creator Monthly) to unlock premium styling, unlimited exports, and additional advanced features.

• Billing & Purchases: All premium purchases, subscription transactions, and renewals are securely processed entirely through the Google Play Store billing system (and/or other official app store platforms). We do not collect or store your financial or credit card information.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless you cancel the subscription through your Google Play Store account settings at least 24 hours before the current period ends.
• Refunds: All refund requests are subject to the policies of the respective app store (e.g., Google Play Store refund policy). We do not directly issue refunds for subscription payments.

C. Add-on Packages

You may purchase individual add-on packs (e.g., extra export packs) to supplement your current plan. Add-on packs are one-time purchases and are subject to the payment terms of the respective app store.

5. User Content and Intellectual Property

A. Your Content

• Ownership: You retain all intellectual property rights and ownership in the videos, audio, text, and other media you upload, edit, or process through the Service ("User Content").
• Processing License: You grant us a limited, secure, non-exclusive, royalty-free, worldwide license to process, transcode, and upload your User Content (specifically the audio track) solely for the purpose of transcribing, generating captions, and providing the Service to you. This processing is transient and media files are deleted immediately after transcription, as detailed in Section 1.
• Responsibility: You represent and warrant that you own or have obtained all necessary licenses, rights, and permissions to use and authorize the processing of your User Content, and that your User Content does not infringe upon any third-party copyrights, trademarks, or privacy rights.

B. App Intellectual Property

The Hinglishly AI Captions application, including its source code, design, user interface, templates, animations, logos, branding, and proprietary assets, is the sole property of Hinglishly AI Captions and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, or decompile any part of our application.

6. Acceptable Use and Prohibited Activities

You agree that you will not use Hinglishly AI Captions to:

• Engage in any illegal, fraudulent, or unauthorized activities.
• Upload or generate content that is unlawful, defamatory, libelous, threatening, harassing, abusive, hateful, or encourages violence.
• Bypass, disable, or tamper with the security, authentication, or billing mechanisms of the application.
• Exceed or attempt to manipulate subscription limits, quotas, or free tier metrics.
• Decompile, reverse engineer, or attempt to extract the source code or proprietary algorithms of the application.
• Use any automated scrapers, bots, or tools to interact with our Service or database.

7. Disclaimers

• "As Is" Basis: The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Transcription Accuracy: Automated transcription and captioning are powered by artificial intelligence and automated speech recognition systems (Deepgram). We do not warrant or guarantee that the generated captions will be 100% accurate, complete, or free of errors. Caption accuracy heavily depends on the clarity of speech, audio quality, and background noise in your uploaded files.
• Service Availability: We do not guarantee that the Service will always be uninterrupted, timely, secure, or completely error-free.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Hinglishly AI Captions, its founders, team members, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to, use of, or inability to access or use the Service.
• Any errors, inaccuracies, or omissions in the auto-generated captions or output videos.
• Unauthorized access to or alteration of your transmissions or data.
• Any content or conduct of any third party on the Service.

9. Changes to These Terms

We reserve the right to update, modify, or replace these Terms of Service at any time. We will notify you of any changes by posting the revised Terms within the application or on our website, and updating the "Last Updated" date at the top of this document. Your continued use of the application after the posting of any changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms and your use of Hinglishly AI Captions shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the competent courts of our operating jurisdiction.
